Hookupers Terms of Service: Legal Agreement for Users

1. Acceptance of Terms

By registering for an account, accessing, browsing, or otherwise using the hookupers website located at hook-upers.com (the "Site") and its related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. 3. User Responsibilities & Conduct

As a condition of your use of the Services, you warrant that you are at least 18 years old (or the age of legal majority in your jurisdiction) and possess the legal authority to enter into this agreement. You agree to use the Services only for lawful purposes and in accordance with these Terms.

You agree NOT to:

6. Attempt to gain unauthorized access to any portion of the Services, other accounts, or computer systems/networks connected to the Services.
7. Use the Services to promote commercial activities or sales without our prior written consent (e.g., advertising, solicitation, pyramid schemes).
8. Post or transmit any content that infringes upon the intellectual property, privacy, or publicity rights of any third party.
9. Solicit passwords or personal identifying information from other users for commercial or unlawful purposes.

You are solely responsible for all content (text, images, videos, etc.) that you upload, post, or transmit through the Services. You represent that you own or have the necessary rights to such content.

4. Intellectual Property Rights

The hookupers platform, including its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof), are owned by hookupers, its licensors, or other providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The "hookupers" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of hookupers or its affiliates or licensors. You must not use such marks without the prior written permission of hookupers.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include any resale or commercial use of the Services or their contents.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall hookupers, its affiliates, directors, employees, licensors, or service providers be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage, arising out of or in connection with your use, or inability to use, the Services, any websites linked to it, any content on the Site, or such other websites, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising from or relating to the Services or these Terms shall not exceed the greater of (a) the amount you have paid to hookupers in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. HOOKUPERS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that (i) the Services will meet your requirements, (ii) the Services will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Services will be accurate or reliable, (iv) the quality of any products, services, information, or other material obtained by you through the Services will meet your expectations, or (v) any errors in the software will be corrected.

Any material downloaded or otherwise obtained through the use of the Services is done at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

7. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Services or use the account deletion tools provided within your account settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of a recognized arbitration institution in London, United Kingdom. The language of the arbitration shall be English.

Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop any actual or threatened unauthorized use or abuse of the Services, or infringement of our intellectual property rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services.
